For the purposes of the Terms and Conditions listed below, the OEM Original Equipment Manufacturer (OEM) is Skeggox Modular Axe Throwing Systems (a trading name of Culverwell Wrought Iron Ltd) or Skeggox Ltd.
1 All supplied equipment remains the property of the OEM until final payment is received.
2 No alteration, including aesthetic, mechanical, and/or technical modification to any supplied equipment is permitted without written consent of the OEM. Any changes made without OEM authority will immediately invalidate any warranty given whether implicit or implied. Further any such unauthorised alteration or change will remove any responsibility of the OEM for any equipment failure or malfunction howsoever caused.
3 Where equipment has been installed by the customer or any 3rd Party, responsibility for the installation and its suitability for purpose lies with the installer customer or 3rd Party.
4 The designs of all equipment supplied by the OEM remain the Intellectual Property of the OEM and may be further legally protected by Design Registration and/or Pending or Granted Patents. Any attempt by any individual, company, or entity to duplicate the designs of the OEM will be challenged and pursued in the strongest legal terms.
5 All equipment orders can be collected from the OEM workshop F.O.C. by the customer. The loading of any supplied equipment including the provision of appropriate insurances, lifting and handling equipment, and PPE is the responsibility of the customer.
6 All equipment delivered to a customer site will be subject to a delivery charge.
7 All equipment which requires installation work at the customers place of business will be subject to an installation charge.
8 The OEM will not be responsible for any damage/injury caused by the inappropriate or improper use of any supplied equipment. Responsibility for any damage/injury caused by the inappropriate or improper use of any supplied equipment lies with the venue operator/customer. Examples of this include but are not limited to instances where a user/maintainer is under the influence of intoxicating substances or where appropriate advice as to the proper use of the supplied equipment has not been sought from the OEM.
9 All invoices must be settled in full prior to the release of any supplied equipment to the customer.
10 Any additional cost adjustments on the part of the customer must be notified to and agreed by the OEM in advance in writing.
11 Where the customer requires supply, delivery, or installation, of any equipment supplied by the OEM at a timescale which meets their own particular needs but does not meet the needs of the OEM any additional cost will be borne by the customer.
12 If a customer requires any alterations to be made to OEM supplied equipment to meet a particular need or requirement once manufacturing of their order has begun, such alterations will only be considered following the submission of a Design Change Request (DCR) and appropriate consultation. A fixed non-refundable fee will be charged for the submission of a DCR and any subsequently agreed works will be invoiced to the customer as appropriate.
